The privatization of airspace in international communications law: challenges to state sovereignty and its impact on the Panamanian legal system

Abstract

The development of aviation, telecommunications and outer space activities has significantly transformed the traditional ways in which States exercise authority over their airspace. This article presents a legal analysis of the so-called privatization of airspace within international communications law, with particular attention to the tension between technical management, private participation and State sovereignty. Using a qualitative, documentary and comparative approach, the study examines international treaties, specialized doctrine, case law, aeronautical regulation and Panamanian legislation. The findings show that the involvement of private companies in air navigation services, telecommunications, airport infrastructure or satellite systems does not, in itself, constitute a transfer of sovereignty. Rather, it represents a functional delegation of technical or operational activities that remains subject to State authorization, supervision and responsibility. In Panama, airspace retains its status as a public and sovereign asset administered by the State through the Civil Aviation Authority. The article concludes that private participation is legally admissible only when it does not compromise operational safety, national jurisdiction, service continuity or compliance with international standards.
